The CBD vs. THC Debate

The Differences Between Marijuana and Hemp

Hemp and marijuana are two different varieties of cannabis. And CBD comes from both types. But hemp contains much less THC than marijuana. The amount is usually less than 0.3%.

Hemp and hemp-derived products are no longer on the Schedule I of the Controlled Substance Act. This means they aren’t believed to have any accepted medical use and abuse is not expected. A paper released by the NIH in 2015 stated there are still many things we don’t know about CBD. But, they believe that use of these products shouldn’t cause impairment for employees. 

Keep in mind that there are some CBD products which derive from marijuana instead of hemp. These products will have significantly higher levels of THC than those made from hemp. A study performed in 2017 found that seven in ten of all CBD products do not contain the amount of THC advertised. This means users may think they are using a product with a certain amount of THC in it, when it is actually much more. CBD products aren’t regulated; so it can be difficult for customers to know exactly how much THC is in the CBD products they buy.

Several US states have legalized the use of CBD oil with most requiring that only hemp extracted is used, and that it contains less than 1% of THC.

What Can Employers Do If They Have Concerns About CBD Use?

The Society for Human Resource Management recently gave the following statement. It is in reference to the complications that cannabis oil can cause with drug testing procedures.

“If an employee is taking CBD or cannabis oil… in accordance with a state’s medical marijuana laws, there may be some state law protections for the employee. Otherwise, employers with zero-tolerance drug policies are free to discipline employees for failing drug testing, even if the ingestion of THC was inadvertent.”
